Cincinnati painting company cited for worker's death

CINCINNATI, OH (FOX19) - The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) has cited a local bridge and tower painting company following the death of a worker.

It's the second time in one month that UCL Inc. in Cincinnati has been cited.

OSHA began its inspection in August after receiving information that a worker, who later died from his injuries, had fallen while employed at a bridge painting site along the I-75 corridor near West Chester.

The inspection resulted in citations alleging a lack of fall protection, training deficiencies, machine guarding issues and scaffolding hazards.  The penalties total $28,500.

In November, UCL Inc. received OSHA citations alleging numerous violations of federal lead exposure hazards, among other violations, with proposed penalties totaling $321,000.  Those citations have been contested by the company and will be scheduled for hearing before the independent Occupational Safety and Health Review Commission.

An OSHA violation is serious if death or serious physical harm can result from a hazard an employer knew or should have known exists.

The company has 15 business days from receipt of the latest citations and proposed penalties to comply, participate in an informal conference with the OSHA area director or contest the findings before the independent Occupational Safety and Health Review Commission.
